Terms and Conditions

In short: PumpkinSnap is a low cost, best effort service. We do not guarantee it will be available at any particular time, and if something goes wrong, the most we will ever owe you is what you paid us.
1. Who we are
PumpkinSnap is a ChrisDigital product, operated by Chris Gavin-Egan trading as ChrisDigital, Dorset BH8 9NH, UK ("we", "us", "our"). Contact: chris@pumpkinsnap.com or 07925 175203.
2. Who these terms apply to
These terms form the agreement between us and the business or organisation that buys a PumpkinSnap plan ("you", "the Operator"). By paying for or using the service you accept these terms. You confirm you are acting for a business and not as a consumer.
3. What the service is
PumpkinSnap lets your staff take branded photos on their own phones, lets visitors claim their photo by entering their email address, shows photos on a display screen, and gives you a list of the contact details your visitors have chosen to share.
Photos are captured from the phone's live camera feed with your frame overlaid. They are portrait only and of lower quality than professional photography. PumpkinSnap is not a replacement for a professional photographer.
4. No guarantee of availability
The service is provided "as is" and "as available". We make no promise that it will be available, uninterrupted, error free or fast at any particular time, including on your busiest days.
The service depends on things outside our control, including mobile signal and venue wifi, phone browsers and camera permissions, our hosting and email providers, and recipients' spam filters. We do not guarantee that any claim email will be delivered, or that it will arrive in an inbox rather than a spam folder. We may carry out maintenance, make changes or suspend the service at any time, and will try to give notice where practical.
You should always have a fallback plan for your event that does not depend on PumpkinSnap.
5. Our liability to you
- 5.1Our total liability to you for all claims arising out of or in connection with these terms or the service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the amount you actually paid us for the plan or period to which the claim relates.
- 5.2We are not liable for any loss of profit, revenue, sales, business, leads, contact data, goodwill or reputation; for wasted staff time or event costs; for the cost of replacement photography or services; or for any indirect or consequential loss, however caused, even if we were told it was possible.
- 5.3Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be limited or excluded.
- 5.4You agree these limits are reasonable given the low price of the service.
6. Price, payment and refunds
- 6.1Plans are paid in advance by card through Stripe, in the currency shown at checkout. Your plan runs for the dates shown at the time of purchase. Plans do not automatically renew.
- 6.2You may cancel for a full refund within 5 working days of the date you paid for your plan.
- 6.3After that, fees are non-refundable, except where the service suffers a complete system failure caused by a fault on our side, meaning it is entirely unusable for more than one consecutive day. In that case we may offer a full or partial refund at our discretion. Any refund will never exceed the amount you paid for that plan.
- 6.4No refunds are given for problems outside our control as described in section 4. This includes, without limitation, the reliability of your phones, tablets, screens, mobile signal, mobile data, venue wifi or internet connection, browser or camera issues on your devices, and emails going to spam. Making sure your equipment and connection work is your responsibility.
7. Your responsibilities
You are responsible for:
- 7.1Making sure you have a lawful basis to collect and use visitors' contact details, including getting proper consent before sending any marketing messages, as required by data protection and electronic marketing law in your country.
- 7.2Displaying clear signage telling visitors that photos are being taken and may appear on a display screen, and getting a parent or guardian's agreement before photographing children.
- 7.3Moderating the display screen and promptly removing any unsuitable photo.
- 7.4Keeping your password, PINs, logins and QR codes secure, and for everything done using them.
- 7.5Your staff's conduct while using the service.
- 7.6Downloading your contact list and any photos you want to keep. They are deleted 60 days after your plan ends, as set out in section 9.5.
8. Your content
You keep ownership of your logo, name and any material you upload. You give us permission to use it to provide the service to you. You confirm you have the right to use it and that it does not infringe anyone else's rights. With your written agreement only, we may mention you as a customer in our marketing.
9. Data protection
- 9.1You are the controller of visitors' personal data collected through your account. We act as your processor.
- 9.2We will process that data only to provide the service and on your instructions as set out in these terms, keep it secure, ensure anyone with access is bound by confidentiality, and tell you without undue delay if we become aware of a personal data breach affecting it.
- 9.3We use trusted third parties to host the service and send email. You agree to us using them.
- 9.4We will help you respond to requests from visitors exercising their data rights where reasonably possible.
- 9.5We will delete photos and contact data from your account 60 days after the end date of your plan, unless the law requires us to keep it. You should download anything you want to keep before then.
10. Acceptable use
You must not use the service for anything unlawful, offensive or misleading, to send spam, or to attempt to access other customers' accounts or interfere with the system. We may suspend or close your account without refund if you do.
11. Our intellectual property
The PumpkinSnap software, website and frames belong to us. Your plan gives you a right to use them for the duration of your plan only.
12. Events outside our control
We are not responsible for any failure or delay caused by events beyond our reasonable control, including failures of hosting, internet, email or payment providers, power cuts, severe weather or cyber attacks.
13. Changes to these terms
We may update these terms from time to time. The version in force when you bought your plan applies to that plan.
14. General
These terms are the entire agreement between us about the service. If any part is found unenforceable, the rest still applies. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
